ALERT: Electronic Wills in DC


A few minutes ago, the Council of the District of Columbia passed emergency legislation to permit anyone without a Will to make one even though they and their witnesses are not in the same physical location.


Yesterday, I highlighted the importance of being prepared during this unique and unprecedented time. I also said the District of Columbia and Maryland required witnesses be physically present when witnessing wills and other legal documents (under ordinary circumstances I am in complete agreement with this policy). Fortunately, the Council and the Mayor realize we are not in ordinary circumstances and have anticipated the urgency of the occasion, and now permit Electronic Wills during this public health emergency. While it is unclear how this affects other important planning documents such as Advance Health Directives (i.e., Living Wills), and Healthcare Power of Attorneys, we at least know wills can be done.
